Terms and Conditions

By accessing and using the Kupito Platform, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and users who post listings.

By registering an account or using the Platform, you represent that you are at least 18 years old and have the legal capacity to enter into legally binding contracts.

Kupito is a non-commercial platform for posting and viewing listings for the sale of vehicles in Moldova. The Platform is free for all users.

The Platform enables users to:

• Post listings for the sale of vehicles free of charge

• Browse and search for vehicle listings

• Contact sellers through the information provided in the listing

• Create profiles and manage their listings

• Save search filters (up to 20 filters per user)

• Install Kupito as a mobile application (PWA) on your devices

• Use the Platform offline with access to cached pages

• Compare up to 3 vehicles and up to 3 tire listings simultaneously

• Add listings to favorites for easy access

• When signed in, optionally request an AI-generated informational analysis for eligible vehicle listings (subject to availability and per-user limits; not professional or mechanical advice)

Kupito acts solely as an intermediary between sellers and buyers. The Platform does not participate in actual transactions between users, does not charge commissions or fees, and does not guarantee any aspect of the sale or the vehicle being sold.

Kupito is a non-commercial initiative; all services are provided free of charge as a community service.

When a listing price is displayed in a currency other than the platform default (e.g. EUR), the Platform may show an approximate equivalent in the default currency for convenience; this is based on daily exchange rates from a third-party rates service (no personal data is sent to that service) and is not binding. The price that counts for the transaction is the one stated by the seller in the listing currency.

To post a listing, you must create a profile on the Platform. When registering, you agree to:

• Provide accurate, complete, and updated information

• Maintain the security of your password

• Take responsibility for managing your account and all activities on your account

• Immediately notify Kupito of any unauthorized use of your account

• Verify your phone number with SMS code during registration

Each user may have only one active account. It is prohibited to use another user's account or to allow another user to use your account.

Users can manage their profile, including personal information, messenger contact preferences (Viber, WhatsApp, Telegram), and email notification preferences. The phone number linked to the account is verified via SMS or, when signing in with Telegram and the user consents, may be taken from Telegram as a verified phone; it can be changed through an SMS verification process; the new number must be unique and verified via SMS code. Legal entities may optionally add an additional contact phone number in their profile or during profile completion; it may be displayed in listings and is not verified via SMS.

To protect against abuse, the Platform applies limitations on the number of SMS code verification attempts and may apply a temporary block after repeated failed attempts.

Kupito reserves the right to suspend or close an account that violates these Terms or is used in an inappropriate manner.

When posting a listing on the Platform, you agree to:

• Post only accurate and complete information about the vehicle

• Not post false, fraudulent, or misleading information

• Not post listings for vehicles that do not exist, are not owned by you, or you are not authorized to sell

• Not post listings for stolen or illegally obtained vehicles

• Use only photographs that accurately depict the vehicle being sold

• Photographs are stored with a third-party cloud provider in the European Union and delivered through a content delivery network for performance

• Images are automatically processed and converted to an optimized format for improved performance

• You may optionally enable automatic masking of license plates on uploaded photos; when enabled, we process images on our servers to overlay a non-removable mask on detected plates. Only static images are accepted; animated images (e.g. GIF) are not supported.

• You may optionally attach a single listing video that accurately represents the vehicle; technical limits (maximum file size and duration, accepted formats) are shown in the listing editor.

• Listing videos are stored and delivered through the same media infrastructure as photos and may be transcoded; temporary upload fragments may be deleted automatically after a short retention period.

• Not post duplicate listings for the same vehicle

• Not post content that is illegal, offensive, defamatory, sexually explicit, violent, or otherwise inappropriate

• Respect the intellectual property of others

• Use the Platform only for legal purposes and in accordance with these Terms

Users can edit their listings while they are active or paused. Closed listings cannot be edited. When editing a listing, users must provide accurate and updated information.

Active listing limits:

• Individual users can have a maximum of 100 active listings simultaneously

• Business users can have a maximum of 1000 active listings simultaneously

• Paused listings do not count towards the active listing limit

• Listings are automatically closed after 90 days from the last update

Kupito may delete, close, ban, or hide any listing or user account that violates these rules, contains unlawful information, is used for selling stolen vehicles, or is otherwise used inappropriately. Where the violation is not urgent or does not pose a material risk to other users, Kupito will, where reasonably practicable, notify the user and allow a reasonable period to remedy the issue before taking final action. Immediate action without prior notice may be taken in cases of serious or repeated violations, fraud, illegal activity, or risk to users or the Platform. This includes, but is not limited to: listings with false information, listings for stolen vehicles, user accounts used for fraud or illegal activities, and any other activity that violates these Terms or applicable laws.

Users are solely responsible for:

• The accuracy and completeness of information provided in their listings

• Communication and agreements between sellers and buyers

• All aspects of transactions, including vehicle inspection, delivery, and payment

• Verifying the identity and credibility of other users

Kupito is not responsible for:

• The quality, safety, or legality of vehicles listed on the Platform

• Users' ability to complete a transaction

• The accuracy of information provided by users

• Any complaints, damages, or losses resulting from the use of the Platform or a transaction

All intellectual property rights in relation to the Platform, including the design, graphics, text, software, and other content, are the property of Kupito or its licensors.

Users retain intellectual property rights to the content they post, but by posting on the Platform, you grant Kupito a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and technically adapt that content (including resizing, format conversion, thumbnails, and similar processing) solely as needed to operate, secure, and reasonably promote the Platform.

It is prohibited to copy, reproduce, or distribute content from the Platform without written permission from Kupito.

Kupito collects and processes personal data in accordance with its Privacy Policy, which is an integral part of these Terms. For detailed information about personal data processing, please consult our Privacy Policy at kupito.club/privacy.

By using the Platform, you agree to the collection, processing, and use of your personal data as described in the Privacy Policy.

User passwords are protected using modern cryptographic hashing and are never stored in plain text. No one, including Platform administrators, has direct access to your passwords.

Important: No Kupito employee can access your passwords in readable form. No Kupito employee will ever ask you to share your password. If someone claiming to be a Kupito employee asks for your password, it is a scam - please contact us immediately at support@kupito.club.

Kupito is committed to the security of users and their data and protects user data from unauthorized access by third parties. All data is stored on secure servers using modern security protocols.

Kupito may disclose personal data to competent authorities only when required or permitted by applicable law and upon a legally valid request, in accordance with applicable laws and regulations and respecting user rights and due process.

Users can choose to receive email notifications through their profile settings. This option is optional and can be enabled or disabled at any time. Email notifications are only sent if the user has a valid email address and has explicitly enabled them.

Kupito protects users' personal data in accordance with the Personal Data Protection Law of the Republic of Moldova and the General Data Protection Regulation (GDPR).

The Platform does not charge commissions, fees, or any payments for posting listings, viewing listings, or using any features.

Kupito may separately agree with selected companies or persons to display their names, logos, links, or informational materials on the Platform. Such placement is made at Kupito's discretion and, unless explicitly stated otherwise, does not create agency, employment, joint activity, financial guarantee, or other legal responsibility of Kupito for the partner's goods or services.

Platform partner status and free promotion bonuses are optional non-cash platform benefits for selected business accounts, are not the property of the user, are not redeemable for money, and are not transferable to third parties.

Kupito may grant, refuse, change, suspend, or revoke partner status, and may adjust, reset, expire, or cancel accumulated free promotion bonuses at any time at its discretion, including in connection with program rule changes, abuse prevention, inactivity, inaccurate account or listing data, or termination of cooperation with the partner.

All transactions between sellers and buyers occur directly between them. Kupito does not participate in payments and is not responsible for any financial transactions.

If in the future Kupito transforms into a commercial organization and begins charging for services, users will be notified in advance of any changes to the payment policy.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.

Kupito does not guarantee that:

• The Platform will operate continuously or without errors

• Errors will be corrected

• The Platform is free from viruses or other harmful components

• Information provided by users is accurate or secure

The display on the Platform of a partner's name, logo, link, or informational material only means that Kupito has allowed such placement within the Platform interface. Unless explicitly stated otherwise, this does not constitute an endorsement, guarantee, or assumption of responsibility by Kupito for the partner's products, services, or statements.

The Platform may redirect you to partner sites (e.g. for vehicle history reports). Use of those services is subject to the partner's terms and privacy policy; Kupito is not responsible for the content, availability, or data processing of partner services.

Optional AI-generated analysis on vehicle listings is provided for general information only, may be incomplete or inaccurate, and does not replace your own checks, a professional inspection, or independent advice. Kupito is not liable for decisions you make based on such analysis.

Kupito is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Platform.

Kupito may terminate, suspend, ban, delete, or hide access to the Platform, user accounts, or listings for any user who violates these Terms, posts unlawful information, uses the Platform for selling stolen vehicles, or otherwise uses it inappropriately. Where the violation is not urgent or does not pose a material risk to other users, Kupito will, where reasonably practicable, notify the user and allow a reasonable period to remedy the issue before taking final action. Immediate action without prior notice may be taken in cases of serious or repeated violations, fraud, illegal activity, or risk to users or the Platform.

Users may terminate their profile at any time themselves via the Profile page (Danger zone → Delete account).

Upon account termination, all data associated with the account may be deleted in accordance with the Privacy Policy.

Kupito may review content and user activity as needed to ensure compliance with these Terms and applicable laws. In case of detection of unlawful activities, Kupito will take appropriate measures, including removal of content and blocking of user accounts where justified.

Kupito may modify these Terms at any time. Revised Terms will be published on the Platform with a "last updated" date and will take effect no earlier than 15 days after that publication.

Registered users who have a valid email address on file will be notified of material changes by email to that address, where reasonably practicable.

If you continue to use the Platform after the effective date of the revised Terms, your continued use constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Platform before the effective date.

You should still review these Terms periodically for any changes.

These Terms are governed by and interpreted in accordance with the laws of the Republic of Moldova.

Before bringing a claim in court, the parties will endeavour to resolve the dispute directly by contacting Kupito at support@kupito.club.

If a dispute cannot be resolved in this way, it shall be submitted to the competent courts of the Republic of Moldova. Consumers retain the right to bring proceedings in the courts of their place of residence where applicable law so provides, and to use other consumer protection mechanisms available under applicable law.

If any part of these Terms is found to be invalid or unenforceable, the remainder of the Terms will remain in effect.

Kupito's failure to enforce any right or provision of these Terms does not constitute a waiver of that right.

These Terms constitute the entire agreement between you and Kupito regarding the use of the Platform.
